ARTICLE 2 – WEBSITE ACCESS

Access to the website and its use are strictly reserved for personal use. You agree not to use this website and the information or data contained therein for commercial, political or advertising purposes, or for any form of commercial solicitation, in particular the sending of unsolicited emails.

INSPERIAL undertakes to ensure that personal data are collected and processed lawfully, fairly and transparently in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of 6 January 1978, as amended.

The data collected are limited to what is strictly necessary in accordance with the data minimisation principle. The definitions in Article 4 of the GDPR apply.

7.1 – What happens in the event of a security breach

INSPERIAL undertakes to implement appropriate technical and organisational measures to provide a level of security appropriate to the risks of accidental, unauthorised or unlawful access, disclosure, alteration, loss or destruction of personal data concerning you.

If we become aware of unlawful access to personal data stored on our servers or those of our providers, or any unauthorised access resulting in one or more of the events described above, we undertake to:

  • inform you of the incident without undue delay where required by law;
  • investigate the causes of the incident;
  • take all reasonable measures necessary to mitigate its negative effects and any resulting damage.

These commitments do not constitute an admission of fault or liability for the occurrence of the incident.

7.2 – Data transfers outside the European Union

INSPERIAL may transfer personal data to entities of the INSPERIAL group or to service providers located outside the European Union, strictly for the purposes described in this Legal Notice.

When such transfers take place, INSPERIAL ensures that:

  • the destination country benefits from an adequacy decision adopted by the European Commission; or
  • appropriate safeguards are implemented, such as standard contractual clauses adopted by the European Commission, where necessary supplemented by additional technical and organisational measures; or
  • where there is neither an adequacy decision nor appropriate safeguards, one of the specific derogations provided for by the GDPR applies, such as the data subject’s explicit consent or the necessity of the transfer for the performance of a contract.

7.3 – Data processors

INSPERIAL ensures that its data processors provide sufficient contractual guarantees regarding the implementation of appropriate technical and organisational measures so that processing meets GDPR requirements.

INSPERIAL may use one or more data processors to carry out specific processing activities under the conditions described in this Legal Notice. Processors may appoint sub-processors only in accordance with the authorisation and contractual requirements agreed with INSPERIAL.

7.4 – Disclosure of personal data to third parties

Where personal data are disclosed to a third party, INSPERIAL ensures that the recipient is subject to appropriate data-protection obligations.

ARTICLE 12 – MANAGEMENT OF DATA ENTERED IN FORMS ON THE INSPERIAL.COM WEBSITE

INSPERIAL has entities in several countries, both within and outside the European Union.

For the purposes described in this Legal Notice, INSPERIAL acts as the main data controller for the insperial.com website. Certain requests may be forwarded to another INSPERIAL group entity where necessary to handle the request, for example to the entity located in the requester’s country.

Information requests submitted through the INSPERIAL website are processed by INSPERIAL’s sales department. Applications submitted through the Careers page are processed by INSPERIAL’s HR department.

The processing enables a person to submit voluntarily:

  • a request for information about INSPERIAL’s products or services; or
  • a spontaneous application or an application in response to a published vacancy.

The information collected is used to respond to and manage the request or application.

12.1.2 – Legal basis

Depending on the purpose of the request, processing is based on one or more of the legal bases described in Article 6(1) of the GDPR:

  • the performance of pre-contractual measures taken at the data subject’s request (Article 6(1)(b) GDPR), where the form is used to request information or a quotation relating to INSPERIAL’s products or services;
  • INSPERIAL’s legitimate interests (Article 6(1)(f) GDPR), in particular to follow up business relationships and improve its services;
  • the data subject’s consent (Article 6(1)(a) GDPR), where the form is used to submit an application or, where applicable, subscribe to a newsletter or similar communication.

12.2 – Data processed

12.2.1 – Categories of data processed

The contact form may collect:

  • first name and surname;
  • company;
  • industry and country;
  • email address and telephone number;
  • the comment or message submitted;
  • the date of the request and related processing information.

Where an application form is provided, it may collect:

  • first name and surname;
  • email address and telephone number;
  • the relevant business unit or location;
  • CV, cover letter and any information contained in those files;
  • the date of the application and related processing information.

The data are supplied directly by people using the contact form or responding to an opportunity through the Careers page.

Fields marked with an asterisk are required so that INSPERIAL can respond to the request or process the application. If the required information is not provided, INSPERIAL may be unable to handle the request or application.

The processing does not involve automated decision-making within the meaning of Article 22 of the GDPR.

  • Gecko Web Solutions Ltd, as website provider and processor where required for hosting, maintenance, security or technical support;
  • INSPERIAL’s sales department for information requests;
  • INSPERIAL’s HR department for applications;
  • the relevant INSPERIAL group entity where necessary to respond to a request.

12.5.2 – Transfers outside the European Union

Certain requests may be forwarded to INSPERIAL group entities or service providers located outside the European Union, including entities in the United States, Canada, the United Kingdom or China, where necessary for the purposes described above.

In such cases, INSPERIAL ensures that appropriate safeguards are implemented in accordance with the GDPR, as described in Article 7.2 of this Legal Notice.

12.6 – Data retention periods

INSPERIAL retains personal data:

  • for information requests, for three years after the last professional contact;
  • for applications, for one year after the relevant position has been filled.

Data collected through cookies and similar technologies are retained only for the period necessary to achieve the purposes described in Article 8 of this Legal Notice, subject to any shorter period selected through the consent-management or analytics configuration.

Deletion procedures are implemented so that data are effectively deleted when the applicable retention or archiving period expires.

12.7 – Security and data-subject rights

Appropriate technical and organisational measures are implemented to protect the website and the personal data processed through it.

12.7.1 – Your rights regarding personal data

In accordance with applicable data-protection law, and in particular the GDPR and the French Data Protection Act, you have the following rights, subject to the conditions established by law:

  • the right of access;
  • the right to rectification;
  • the right to erasure;
  • the right to restriction of processing;
  • the right to object, including the right to object at any time to processing for direct marketing;
  • the right to data portability where applicable;
  • the right to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

You also have the right to lodge a complaint with the French Data Protection Authority (CNIL) if you believe that the processing of your personal data infringes applicable law.

12.7.2 – Applicable law and language

This Privacy Policy is governed by French law. It is drafted in French. If it is translated into one or more languages, the French text shall prevail in the event of a dispute.

If any provision is held to be invalid, the remaining provisions shall continue in full force and effect. A party’s temporary or permanent failure to enforce one or more provisions does not constitute a waiver of the remaining provisions.
